These Terms of Use govern your access to and use of mediatingediscovery.com (the “Site”), an informational website concerning the neutral practice of Daniel B. Garrie, operated by Law & Forensics LLC. By using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

1. Informational only; no legal advice

The Site provides general information about discovery-dispute resolution and the neutral practice of Daniel B. Garrie. Nothing on the Site is legal advice, and your use of the Site does not create an attorney–client or any other professional relationship. Do not act, or refrain from acting, on the basis of Site content without seeking advice from qualified counsel admitted in the relevant jurisdiction.

2. Engagement is administered through JAMS

Engagement of Mr. Garrie as a neutral — whether as a Special Master, discovery referee, forensic neutral, arbitrator, or mediator — is administered exclusively through JAMS. Submitting an inquiry or otherwise contacting us through the Site does not retain Mr. Garrie and does not create any engagement. Sample order and stipulation language provided on the Site, including on the Model Orders page, is illustrative only, is not legal advice, and should be adapted with counsel for the specific forum and matter.

3. Intellectual property

The Site and its content — including text, design, layout, and graphics — are owned by Daniel B. Garrie or licensed to us, and are protected by copyright and other laws. You may view and print materials from the Site for your own non-commercial, professional reference, provided you retain all copyright and other notices. All trademarks are the property of their respective owners; “JAMS” is a trademark of its owner, and references to it are for identification only.

4. Permitted use and prohibited conduct

You agree to use the Site only for lawful purposes. You may not use the Site to post or transmit any material that is unlawful, or that constitutes or encourages conduct that would violate any law, or to interfere with the operation of the Site. We reserve the right to delete, modify, or supplement Site content at any time.
